Welcome to CapyFin (“Company”, “we”, “our”, “us”), a company registered in Malta with address at Burmarrad Road, Level 2, The Fort Hardrocks Business Park, Naxxar, NXR 6345, Malta.
These Terms of Service (“Terms”) govern your use of our website located at https://capyfin.com and any related services we provide, including our subscription products and application programming interface (collectively, the “Service”).
Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard, and disclose information that results from your use of our Service. Please read it here: https://capyfin.com/legal/privacy.
Your agreement with us includes these Terms and our Privacy Policy (together, the “Agreements”). By accessing or using the Service, you acknowledge that you have read and understood the Agreements and agree to be bound by them.
If you do not agree to the Agreements, you may not use the Service. If you have questions, contact us at info@capyfin.com.
For purposes of these Terms, the following definitions apply:
By accessing or using the Service, you represent that you are at least eighteen (18) years old and have the full authority, right, and capacity to enter into these Terms.
When you create an Account, you agree to provide accurate, complete, and current information at all times. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your Account.
You must notify us promptly at info@capyfin.com if you suspect any unauthorized access or use of your Account.
By creating an Account, you may receive transactional emails (for example, receipts, security notices, and product updates). If you opt in to marketing communications, you may unsubscribe at any time using the unsubscribe link or by emailing info@capyfin.com. You cannot opt out of essential transactional communications.
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”), typically monthly or annually depending on your selected plan.
We use third-party payment processors (for example, Stripe) to process payments. By purchasing a Subscription, you authorize us and our payment processors to charge your selected payment method for recurring charges and any applicable taxes.
You agree to provide accurate and complete billing information. You are responsible for keeping your payment method current and valid.
If automatic billing fails, we may retry the charge and/or suspend access to the Service until payment is successfully processed. We may also issue an electronic invoice requiring manual payment within a stated deadline.
Taxes (including VAT): Prices may be displayed inclusive or exclusive of VAT and other taxes depending on your location and the checkout configuration. You are responsible for all applicable taxes, levies, or duties, unless otherwise stated at checkout.
Chargebacks and payment disputes: If you initiate a chargeback or payment dispute, we may suspend access to the Service while the dispute is pending. Excessive chargebacks or suspected fraud may result in termination.
Subscriptions automatically renew at the end of each Billing Cycle unless you cancel before the renewal date.
You may cancel through your Account settings (if available) or by contacting support at info@capyfin.com. Unless otherwise stated at checkout or in a separate written agreement, cancellation takes effect at the end of the current Billing Cycle. You will retain access until the end of the current Billing Cycle, and you will not be charged for the next Billing Cycle.
API access after cancellation: If you cancel an API Subscription, your API access will remain available through the end of the paid Billing Cycle, unless it is suspended earlier for non-payment, abuse, or breach of these Terms, or unless you request immediate cancellation and we confirm the effective date.
CapyFin may, at its sole discretion, offer a Subscription with a free trial for a limited period of time (“Free Trial”).
You may be required to enter billing information to start a Free Trial. If you do, you will not be charged until the Free Trial expires. On the last day of the Free Trial, unless you cancel, you will be charged the applicable Subscription fee for the selected plan.
We may modify or cancel Free Trial offers at any time, including eligibility, duration, and availability.
We may change Subscription fees at any time. Any fee change will take effect at the end of the then-current Billing Cycle.
We will provide reasonable notice of material fee changes where required. Continued use of the Service after a fee change becomes effective constitutes your agreement to pay the updated fees.
Except when required by law (including applicable EU consumer rights), paid Subscription fees are non-refundable.
The Service and API provide information about public companies (including earnings calendars, earnings dates, earnings results, related metrics, and other market or event data) for informational purposes only.
CapyFin does not provide investment, legal, tax, or accounting advice. Nothing on the Service or provided via the API constitutes a recommendation, solicitation, or endorsement to buy, sell, or hold any security or to pursue any investment strategy.
Data may be delayed, incomplete, inaccurate, or changed by upstream sources. “Real-time” or similar descriptions refer to best-efforts processing and do not guarantee immediate availability or accuracy. You are solely responsible for any decisions made in reliance on the Service or API, including trading decisions.
If you subscribe to an API plan, the following terms apply to your use of the data and functionality provided through our API (“API Data”).
(a) License Grant by Plan Type:
(b) API Credentials: API keys and credentials are issued to you and must be kept confidential. You may not share, sell, transfer, or publicly expose API credentials. You are responsible for all activity conducted using your API credentials. We may revoke, rotate, or reissue credentials at any time, including for security reasons.
(c) Rate Limits and Quotas: API access is subject to rate limits, quotas, and usage rules defined by your Subscription plan and our Documentation. We may throttle, limit, or suspend API access if your usage exceeds limits, threatens service stability, or indicates abuse.
(d) Caching and Storage: You may temporarily cache API Data solely to improve performance, provided that cached data is refreshed at least every twenty-four (24) hours. Permanent storage, archival, or dataset-building beyond this caching window is prohibited unless explicitly permitted in writing by CapyFin (for example, under an Enterprise Agreement).
(e) No Resale: Except as explicitly permitted in an Enterprise Agreement, you may not resell, sublicense, redistribute, or commercialize API Data or access to the Service.
(f) No Competing Use (Business Users): If you are a Business User, you may not use the Service or API Data to create or improve a product or service whose primary purpose is substantially similar to CapyFin, including providing an earnings calendar, earnings results feed, or comparable market-event dataset via an API or similar interface.
(g) Documentation and Changes: Your use of the API must comply with our then-current Documentation. We may modify, deprecate, or discontinue API endpoints or features at any time. Where practical, we will make reasonable efforts to provide advance notice of material breaking changes, but we do not guarantee any specific notice period.
(h) Attribution: If your plan or Enterprise Agreement requires attribution or source acknowledgment, you agree to comply with those requirements as specified in writing by CapyFin.
(i) Suspension: We may suspend or terminate API access immediately for non-payment, chargebacks, suspected fraud, security risks, excessive usage, or breach of these Terms.
The Service may include information obtained from public sources and/or third-party providers. We do not control third-party sources and are not responsible for third-party outages, errors, omissions, or changes in source data.
Except where explicitly stated, third-party names, trademarks, and content are the property of their respective owners and are used for identification purposes only.
You agree not to use the Service:
Subject to these Terms and your compliance with them, CapyFin grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal use (if you are a Consumer) or internal business purposes (if you are a Business User), as applicable.
Except as expressly permitted under these Terms (including Section 11 for API plans) or a separate written agreement, no rights are granted to you, and CapyFin reserves all rights, title, and interest in and to the Service.
You represent and warrant that you are not located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive sanctions or embargoes, and that you are not subject to sanctions, or listed on any restricted or denied party list, under applicable laws. You agree not to use the Service in violation of applicable export control or sanctions laws.
The Service may allow you to submit certain information to us (for example, support requests, feedback, or other communications) (“User Content”). Unless the Service explicitly provides a feature for publishing user-generated content publicly, User Content is not publicly posted by default.
You represent and warrant that you have all rights necessary to submit User Content and that doing so does not violate any law or any third-party rights.
You grant CapyFin a worldwide, non-exclusive, royalty-free license to use, reproduce, and process User Content solely to operate, maintain, and improve the Service, including providing support.
If you provide feedback, suggestions, or ideas, you agree that we may use them without restriction or compensation, and you waive any claims to ownership or payment related to such feedback, to the extent permitted by law.
The Service, including its software, design, text, graphics, and other original content (excluding third-party content and User Content) is the exclusive property of CapyFin and its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted under these Terms or a separate written agreement with CapyFin.
We respect intellectual property rights. If you believe content on the Service infringes your copyright, please email info@capyfin.com with the subject line “Copyright Infringement” and provide sufficient detail to locate the material and evaluate your claim.
We may request additional information to process your complaint and may remove or restrict access to material as appropriate.
We may use third-party service providers to monitor and analyze Service usage.

The Service may contain links to third-party websites or services not owned or controlled by CapyFin. We are not responsible for third-party content, policies, or practices.
You access third-party websites at your own risk. We encourage you to read their terms and privacy policies.
We may provide customer support via email at info@capyfin.com. Support response times are best-efforts and not guaranteed unless stated in a separate written agreement.
We may perform maintenance that limits availability. The Service is provided on an “as is” and “as available” basis and we do not provide a service level agreement unless explicitly agreed in writing.
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPYFIN DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION, INCLUDING FINANCIAL, MARKET, OR EVENT DATA PROVIDED VIA THE SERVICE OR API.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CAPYFIN OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR API, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPYFIN’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED (A) THE AMOUNT PAID BY YOU TO CAPYFIN FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) IF YOU HAVE NOT PAID CAPYFIN FOR USE OF THE SERVICE IN THAT PERIOD, EUR 100, WHICHEVER IS GREATER.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
If you are a Business User, you agree to defend, indemnify, and hold harmless CapyFin and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees and costs) arising out of or related to (a) your access to or use of the Service or API, (b) your violation of these Terms, (c) your violation of any applicable law or regulation, or (d) your infringement of any third-party rights, including intellectual property or privacy rights. This section applies only to the extent permitted by applicable law.
We may suspend or terminate your Account or access to the Service immediately, without prior notice or liability, if we reasonably believe you have violated these Terms, if your use poses a security risk, if you engage in abuse, or for non-payment or chargebacks.
Upon termination, your right to use the Service will cease immediately. You must stop accessing and calling the API immediately once your API access ends.
Deletion of cached API Data: Upon termination or expiration of your API access, you must delete any cached API Data within seven (7) days, unless retention is required by applicable law. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.
We will not be liable for any delay or failure to perform due to events beyond our reasonable control, including failures of third-party providers, internet or hosting outages, acts of government, labor disputes, natural disasters, war, terrorism, civil unrest, or other force majeure events.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms (in whole or in part) in connection with a merger, acquisition, corporate reorganization, sale of assets, or by operation of law.
Notices from CapyFin: We may provide notices to you by email to the address associated with your Account, through the Service, or by other reasonable means. Notices are effective when sent, posted, or made available through the Service, as applicable.

These Terms shall be governed by and construed in accordance with the laws of Malta, without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Courts of Malta, without prejudice to any mandatory consumer protection laws that may apply in your country of residence within the European Union.
If you are a Consumer resident in the European Union, you benefit from mandatory provisions of consumer law in your country of residence. These Terms do not limit any consumer rights that cannot be waived under applicable law.
You may have a right to withdraw from this agreement within 14 days without giving any reason. Where applicable, if you request that we begin providing the Service during the withdrawal period, you may be required to pay a proportionate amount for services provided up to the time you inform us of your withdrawal, as permitted by law.
Where applicable, if the Service has been fully performed during the withdrawal period, your right of withdrawal may be lost if you expressly consented to the beginning of the performance and acknowledged that you would lose your right of withdrawal once the Service has been fully performed.
To exercise a withdrawal right (where applicable), please email info@capyfin.com with the subject line “Withdrawal” and include the email address used for your Account and sufficient details to identify your purchase. If we provide a withdrawal or cancellation function in the Service, you may also use that function.
We reserve the right to modify, suspend, or discontinue the Service (in whole or in part) at any time. We will not be liable if any part of the Service is unavailable for any period, subject to applicable law.
We may amend these Terms at any time by posting updated Terms on this page. It is your responsibility to review these Terms periodically.
If we make material changes, we may provide notice through the Service or by email. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
No waiver by CapyFin of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
These Terms constitute the entire agreement between you and CapyFin regarding the Service and supersede any prior agreements or understandings regarding the Service, unless you have an Enterprise Agreement or other separate written agreement with CapyFin.
